• Good afternoon Doug, Great to visit with you. I have reviewed the proposed SAMPLE agreement as it has been provided. While overall, I do not have any concerns, the following are items for the Board to understand/consider and, if appropriate, see if the County might modify in the specific agreement with the Association:
• Articles I, II and IV require that all costs associated with the construction of any amenities/facilities/trails/etc. to be paid by the Association;
• Article V places requires the Association to maintain and repair any amenities/facilities/trails/etc. as well as maintain the entire Recreational Area;
• Article VIII requires that the Recreational Area is open to the public and that no fee can be charged for entry or use to anyone even if not a member of the Association; and
• Article IX only requires a 30 day notice to terminate the agreement, it might be worth seeing if that could be extended to 60 days instead.

• Doug, Thanks for the call earlier this week, and we are excited that the community voted in favor of proceeding with the full drainage project to include conversion of the existing pond into a detention facility. We acknowledge the POA’s desire to finalize property negotiations and execute the interlocal agreement. HCED will coordinate with the engineer of record to determine when the two exhibits will be completed and schedule a meeting to sit down with the executive board on the options for adding any additional betterments to the project.
In addition to the progression of the ILA, we have submitted a grant application for 100% of the estimated construction costs. The timing of that funding is still unknown at this time, but we anticipate the February/March 2024 timeframe. •

• This evening we held a special meeting to announce the results of the vote taken on whether to accept the financial amount offered by Harris County of the lake area easement. The counts are as follows:
• Ballots sent: 224 • Votes Received: 126 • For Acceptance: 87 • Against Acceptance: 39 • The “For’s” have it with a 69% majority
Congratulations, we now have a stress relieving $450,000 heading to our bank account. Next step is to negotiate the terms and services of the final agreement •
